This document sets forth the terms and conditions governing the use of the DOUBLE BLIND mobile application and related services, as well as the fundamental rules of the software license granted to users. The purpose of this document is to clearly define the rights, obligations, risks, and limitations of liability associated with the use of the Service.
By downloading, registering for, accessing, or using the Application or any of its features, the User acknowledges that they have read, understood, and agree to be bound by these Terms.
This document is intentionally comprehensive in order to address matters related to dog sports, educational activities, field exercises, GPS location data, GPX files, image uploads, subscriptions, and third-party authentication services. These Terms shall be interpreted in accordance with applicable laws.
1. Service Provider and Scope of the Terms
The Application is operated by the Kutyás Oktatási és Sport Alapítvány (Canine Education and Sport Foundation), registered office: 1121 Budapest, Szanatórium utca 7., Hungary, tax number: 19411996-1-43, represented by Andrea Bondor and Darinka Györki (hereinafter referred to as the “Service Provider”).
These Terms apply to the DOUBLE BLIND mobile application, including all modules, educational content, training exercises, proprietary mapping systems, GPS functions, GPX import features, image-upload functionality, and related support, subscription, and customer-service functions.
These Terms apply to both registered and non-registered users to the extent that the relevant functionality is available to them.
2. Nature and Purpose of the Service
DOUBLE BLIND is an educational, sporting, and training-support application. Its purpose is to support the learning, practice, organization, documentation, and review of mantrailing and related canine activities.
The Application may contain tasks, exercises, methodological recommendations, training scenarios, evaluation criteria, track descriptions, guidance for hidden persons, and other educational content.
All content provided within the Application is intended solely for educational and informational purposes. It does not constitute individualized professional, veterinary, medical, occupational safety, land-use, disaster-management, rescue, or security advice.
3. Not an Official Search or Rescue System
DOUBLE BLIND must not be used for real missing-person searches, official rescue operations, disaster-response activities, law-enforcement operations, or any situation where human life, physical safety, or property protection directly depends on information or functionality provided by the Application.
The User acknowledges that the Application is intended exclusively for training and sporting purposes. The Service Provider expressly disclaims any liability arising from the use of the Application in real emergency situations, search-and-rescue operations, or other life-critical circumstances.
4. Registration, Account and Login
Certain features are available only to registered users. Users may create an account using an email address or through third-party authentication services, including Google, Facebook, and X login options.
The User is solely responsible for maintaining the security of their account, password, login credentials, and devices. The Service Provider shall not be liable for damages arising from unauthorized account access, stolen devices, shared passwords, or inadequate security practices.
5. License Grant and Relationship to Platform EULAs
The Service Provider grants the User a limited, non-exclusive, revocable, non-transferable, and non-sublicensable license to use the Application on the User’s own device for personal, non-commercial purposes.
The license does not permit the User to copy, reverse engineer, commercially exploit, reproduce, or distribute the Application’s source code, databases, technical solutions, or content systems.
Where the Application is distributed through Apple App Store or Google Play, the mandatory user or licensing terms of the relevant platform may also apply.
These Terms supplement and do not replace any applicable platform End User License Agreement (EULA). In practice, these Terms function as the Application-specific Terms of Use and custom EULA, while any platform-standard EULA may continue to apply independently.
6. Educational Content, Tasks and Exercises
The tasks, exercises, levels, descriptions, recommendations, examples, and evaluation criteria presented within the Application are intended solely to support educational activities.
The User acknowledges that such content does not guarantee any specific learning outcome, examination result, competition result, training achievement, or behavioural change in a dog.
The User must evaluate and apply all content in light of their own professional judgment, the condition of the dog, their own experience and training, environmental conditions, weather conditions, and applicable local regulations.
The Service Provider accepts no responsibility where a User selects, adapts, or performs an exercise that is excessively difficult, unsafe, unlawful, or unsuitable for the circumstances.
All exercises are performed entirely at the User’s own risk.
7. Assumption of Risk and Use at Own Responsibility
The User expressly acknowledges and agrees that all dog-sport activities, field-training exercises, hiding exercises, tracking exercises, outdoor activities, and movement-based tasks are carried out entirely at the User’s own risk and responsibility.
Such risks include, without limitation: falls, slips, and trips; collisions with terrain features or obstacles; traffic-related hazards; conflicts with other dogs or animals; adverse weather conditions; dehydration; hypothermia; insect or tick bites; accidental entry onto private property; becoming lost or disoriented; a dog escaping or becoming lost; injury to the dog; injury to the handler; injury to hidden persons or assistants; damage to third parties; and loss or damage to equipment, collars, leashes, tracking devices, or vehicles.
The User represents that they will use the Service only in a manner appropriate to their own abilities, the dog’s abilities, the abilities of participants, relevant health conditions, and the characteristics of the training environment.
The User acknowledges and accepts that outdoor training activities may involve natural and environmental hazards, including, without limitation:
- poor visibility conditions,
- water crossing and steep inclines,
- slippery or unstable ground,
- extreme weather conditions (including storms, excessive heat, and cold),
- the presence of wildlife.
8. Responsibility for Dog Handling and Personal Safety
The handling, supervision, control, equipment, recall reliability, stress tolerance, health condition, and safe participation of a dog remain solely the responsibility of the User.
The User must ensure that the dog is fit for the intended activity, appropriately secured, and that the activity does not endanger the dog, other persons, animals, or property.
The Service Provider accepts no liability for injury, stress, trauma, illness, or any other adverse consequence suffered by dogs, handlers, hidden persons, assistants, spectators, or third parties.
9. Terrain, Environment and Lawful Use of Locations
The User is solely responsible for verifying whether a particular training location, route, track, GPX file, park, forest, field, street, public area, or private property may lawfully be used for the intended training activity.
The User shall comply with all applicable laws, land-use restrictions, environmental regulations, forestry regulations, traffic regulations, public-space regulations, animal welfare rules, and any other applicable legal requirements.
The Service Provider shall not be liable for any consequences arising from unauthorized use of land, selection of prohibited locations, environmental damage, regulatory actions, fines, penalties, or disputes with third parties.
10. Limitations of GPS, Maps, Tracks and GPX Data
The Application may utilize proprietary mapping systems, GPS location data, and GPX files. Due to their technical nature, such data may be inaccurate, incomplete, delayed, or subject to misinterpretation.
GPS inaccuracies, weak signal coverage, device malfunctions, software errors, faulty imports, faulty exports, incorrect maps, shifted coordinates, display errors, and user errors may occur.
Users shall not rely exclusively on information displayed within the Application when making decisions affecting their own safety or the safety of others.
The Service Provider does not guarantee the accuracy, completeness, reliability, or timeliness of maps, routes, tracks, or GPX files.
The Application does not constitute a navigation device.
11. User Content and Associated Risks
Users may upload content to the Application, including dog photographs, GPX files, self-created tracks, notes, track descriptions, and related information.
The User is solely responsible for the legality, accuracy, and non-infringing nature of uploaded content and for ensuring that all necessary rights and permissions exist for such content.
The Service Provider shall not be liable for exercises carried out on the basis of user-generated content, incorrectly interpreted descriptions, defective GPX files, inaccurate instructions, or training tasks that prove dangerous or unsuitable.
Tracks are not visible to other users by default. However, Users must ensure that uploaded content does not contain unauthorized personal data, confidential information, sensitive information relating to private property, or content infringing the rights of others.
The processing of personal data is governed by the separate Privacy Policy.
The Service Provider is not obligated to review user-generated content prior to publication.
12. Prohibited Conduct
The User shall not use the Application in any unlawful, misleading, harmful, or disruptive manner.
Prohibited activities include, without limitation: uploading unlawful or offensive content; unauthorized use of another person’s account; automated data collection or scraping; distribution of malicious code; reverse engineering the Application; denial-of-service or similar attacks; unauthorized acquisition of routes, photographs, or data belonging to others; and creating the appearance of acting on behalf of a public authority, rescue organization, governmental body, or competition organizer.
The Service Provider reserves the right to restrict, suspend, or terminate access for Users who violate these Terms.
13. Subscriptions, Digital Purchases and Platform Rules
Deletion of a User account does not automatically cancel an active subscription. Users must cancel subscriptions through the subscription-management interface of the relevant platform (Apple App Store or Google Play).
Subscriptions remain available until the end of the prepaid billing period unless otherwise provided by the relevant platform.
Certain features of the Application may require payment or an active subscription.
Subscription management may be handled through Apple App Store or Google Play systems.
Prices, plans, billing cycles, renewals, cancellations, and refund procedures may be governed in whole or in part by the policies and technical processes of the relevant platform.
The Service Provider shall not be responsible for technical or contractual matters arising from payment systems operated by third-party platforms.
Users remain responsible for complying with all applicable platform policies.
14. Consumer Information and Consumer Rights
This section applies exclusively to Users qualifying as consumers under applicable law. A consumer is a natural person acting outside their trade, profession, or business activities.
Information relating to paid features, subscription plans, trial periods, pricing, billing cycles, automatic renewals, payment methods, and applicable taxes shall be displayed during the purchase process and/or within the relevant application marketplace.
Before completing a purchase, Users are responsible for verifying the selected plan, duration, price, and payment method.
Where purchases are made through Apple App Store or Google Play Store, payment processing, subscription management, renewals, cancellations, and refunds are primarily governed by the rules and technical processes of the relevant platform.
Deleting the Application alone does not necessarily terminate an active subscription.
Consumers generally have a statutory right of withdrawal or cancellation within fourteen (14) days for distance contracts. However, for digital content and digital services supplied without a tangible medium, this right may be lost where performance begins with the consumer’s prior express consent and acknowledgment.
Where immediate access to digital content or services is provided, Users shall be informed during the purchase process that their withdrawal rights may be limited or extinguished under applicable law.

The Service Provider shall respond in writing within thirty (30) days.
Consumers may also seek dispute resolution through the competent conciliation body or alternative dispute-resolution authority.
Nothing in these Terms limits any mandatory consumer rights granted under applicable law.
15. No Guarantee of Results; No Professional, Veterinary or Medical Warranty
The Service Provider does not guarantee that use of the Application will result in any specific learning outcome, dog-training achievement, examination result, sporting result, behavioural change, or professional development.
The Application does not replace professional instruction, responsible handler decision-making, veterinary care, site-specific risk assessment, or the use of appropriate protective equipment.
The User remains solely responsible for all decisions and actions taken during training activities.
16. Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider excludes all liability arising from the use of the Application.
Nothing in these Terms shall exclude or limit liability for damages caused by intentional misconduct or gross negligence where such limitation is prohibited by law.
17. Indemnification
The User agrees to indemnify, defend, and hold harmless the Service Provider from and against any claims, damages, liabilities, losses, costs, fines, penalties, legal proceedings, attorney fees, and expenses arising out of or related to:
violation of these Terms;
content uploaded by the User;
damage caused by the User’s dog;
unlawful use of land or property; or
personal injury or property damage caused during activities performed by the User.
The User shall bear full responsibility for such claims and their consequences.
18. Intellectual Property
The structure, name, graphical elements, proprietary mapping solutions, educational materials, training systems, texts, images, icons, database structures, and other protected elements of the Application may constitute the intellectual property of the Service Provider and/or its authorized partners.
The User acquires no ownership rights in relation to such materials through use of the Application, except with respect to content uploaded by the User and subject to the applicable provisions governing such content.
Users may not copy, reproduce, distribute, modify, publish, commercially exploit, or otherwise use any protected content without the prior written consent of the Service Provider.
19. Service Availability, Modification and Termination
The Service Provider does not guarantee that the Application will operate without interruption, without errors, or identically across all devices and platforms.
The Service Provider reserves the right at any time to modify, suspend, or discontinue:
Application features and functionalities; educational content; training systems; subscription plans; technical solutions; and other elements of the Service.
The Service Provider may suspend or terminate a User account where the User: violates these Terms; endangers other persons; compromises the integrity or security of the Service; or otherwise interferes with the proper operation of the Application.
20. Privacy
The processing of personal data is governed by the separate Privacy Policy available within the Application and on the official website of the Service Provider.
The User acknowledges that use of the Service may involve the processing of: location data; login information; technical information; and user-generated content, as further described in the Privacy Policy.

The Service Provider shall investigate and respond to complaints in writing within thirty (30) days of receipt.
In the event of a consumer dispute, the User may seek resolution through the competent conciliation body or alternative dispute-resolution authority.
22. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Hungary, subject to any mandatory consumer-protection laws and applicable private international law provisions.
The parties shall first attempt to resolve disputes amicably through direct negotiations.
If no amicable resolution can be reached, disputes shall be submitted to the competent courts of Hungary.
For matters not expressly regulated by these Terms, the provisions of Act V of 2013 on the Hungarian Civil Code (Ptk.) shall apply.
The parties agree to cooperate in good faith and seek peaceful resolution of disputes whenever possible.
Any dispute arising out of or relating to these Terms shall be subject to the jurisdiction of the Budai Központi Kerületi Bíróság (Central District Court of Buda) and the Tatabánya Regional Court, provided that the applicable rules of jurisdiction do not require proceedings before another competent court in Budapest or Pest County.
Nothing in this section limits any mandatory rights afforded to consumers under applicable law.
23. Age Restrictions
Use of the Application is recommended for persons aged eighteen (18) years or older.
Persons under eighteen (18) years of age may use the Application only under the supervision of a parent or legal guardian.
Persons under thirteen (13) years of age may use the Application only in compliance with applicable data-protection legislation and other relevant laws.
The Service Provider accepts no responsibility for activities carried out by minors without appropriate supervision.
24. Force Majeure
The Service Provider shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to:
network outages;
failures of third-party service providers;
utility interruptions;
natural disasters;
governmental actions; and
other force majeure events.
Such circumstances shall not constitute a breach of these Terms by the Service Provider.
25. Miscellaneous Provisions
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
The Service Provider reserves the right to amend these Terms at any time.
Unless otherwise required by law, amended Terms shall become effective upon publication within the Application or through another appropriate communication channel.
Users shall be notified of material amendments at least thirty (30) days before they become effective.
If a User does not agree with an amendment, the User may terminate the contractual relationship before the amendment takes effect.
